Terms of Service
Last updated: January 2026
These Terms of Service ("Terms") govern your purchase and use of products sold by HandbookGuard ("HandbookGuard," "we," "us"). By purchasing or using our products, you agree to these Terms.
1. What we sell
HandbookGuard sells a downloadable, editable employee handbook document template (the "Kit"), localized to a specific U.S. state, delivered as a Word (.docx) and PDF file by email. The Kit is a self-help document template for general informational purposes.
2. Not legal advice
HandbookGuard is not a law firm and does not provide legal advice, and no one at HandbookGuard is acting as your attorney. Purchasing or using the Kit does not create an attorney-client relationship.
The Kit is a self-help document template: you (or someone at your company) fill in your own company-specific details using the blanks and instructions we provide. HandbookGuard does not review your company's individual facts, does not select which optional clauses apply to your specific situation, and does not draft or customize any part of the document on your behalf based on legal advice tailored to you. That distinction matters — it's what makes this a self-help tool rather than a legal service, and it's your responsibility to fill it in correctly and have it reviewed. The Kit is not a substitute for review by a licensed attorney in your state, and we strongly recommend having any handbook reviewed by your own counsel before distributing it to employees.
3. Orders and payment
Payments are processed securely by Stripe, Inc. We do not receive or store your full card number — Stripe handles all payment data directly. Prices are shown in U.S. dollars at checkout. Each Kit purchase is a one-time charge; it is not a subscription and will not renew or rebill automatically.
4. Delivery
Kits are delivered by email to the address provided at checkout. Most orders are fulfilled within 24–48 hours of purchase. If you haven't received your Kit within that window, email us at hello@handbookguard.com and we'll resolve it promptly.
5. Refunds
All purchases are covered by our 30-Day Money-Back Guarantee. See that page for full details on how to request a refund.
6. License to use the Kit
Upon purchase, we grant you a non-exclusive, non-transferable license to use, edit, and distribute the Kit internally within your own business. You may not resell, sublicense, or redistribute the Kit (in original or modified form) as a standalone product to third parties, or use it to build a competing product or service.
7. Acceptable use
You agree not to use our site to attempt unauthorized access to our systems, interfere with the normal operation of the site, or use automated means to scrape or bulk-download content without our written permission.
8. Intellectual property
All content on this site and in the Kit template itself — except the identifying details you add about your own company — remains the property of HandbookGuard.
9. Disclaimer of warranties
The Kit and this site are provided "as is" without warranties of any kind, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Kit satisfies every legal requirement applicable to your specific business, industry, or locality.
10. Limitation of liability
To the maximum extent permitted by law, HandbookGuard's total liability arising out of or relating to these Terms or your purchase will not exceed the amount you paid us in the 12 months before the claim arose. We are not liable for indirect, incidental, consequential, or punitive damages, including damages arising from employment disputes, regulatory penalties, or legal fees, even if we've been advised of the possibility of such damages.
11. Dispute resolution and arbitration
Please read this section carefully. It affects your legal rights, including your right to file a lawsuit in court.
You and HandbookGuard agree to resolve any dispute arising out of or relating to these Terms or your purchase through binding individual arbitration, rather than in court, except that either party may bring an individual claim in small claims court instead, and either party may seek injunctive relief in court to prevent infringement or misuse of intellectual property.
Arbitration will be administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. You and HandbookGuard each waive the right to a jury trial and the right to participate in a class action, class arbitration, or representative action. Any arbitration will be conducted on an individual basis only.
Opt-out: You may opt out of this arbitration agreement by emailing hello@handbookguard.com with the subject line "Arbitration Opt-Out" within 30 days of your purchase, including your name and order email. If you opt out, this arbitration section won't apply to you, but the rest of these Terms still will.
12. California disclosures
If you are a California resident, under California Civil Code § 1789.3 you may contact us with questions or complaints at hello@handbookguard.com. You may also reach the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs in writing at 1625 North Market Blvd., Suite N-112, Sacramento, CA 95834, or by telephone at (800) 952-5210.
13. Changes to these Terms
We may update these Terms from time to time. Material changes will be reflected by updating the "Last updated" date above. Continued use of the site after changes constitutes acceptance.
14. Governing law
These Terms are governed by the laws of the State of Colorado, without regard to conflict-of-law principles. The state and federal courts located in Colorado will have exclusive jurisdiction over any dispute not subject to arbitration under Section 11.
